In Ohio, divorce is a termination of marriage by the Court of the marital relationship of the parties. These documents and instructions are for uncontested divorces under either of the no-fault grounds of (1) incompatibility or (2) living separate and apart without interruption without cohabitation for one year. The parties are the Plaintiff, the spouse that initiates the divorce action and the person who will be filing most of the forms and documents with the court, and the Defendant, the other spouse.
Dissolution is an alternative to divorce which dissolves a marriage and is addressed under Ohio Revised Code §3105.61-65. The parties (both spouses) are considered Co-Petitioners and they petition the court together to request a dissolution of marriage. These documents and instructions include a Marital Separation Agreement (MSA) that is to be signed by both parties in the presence of a notary. A MSA is an agreement between the parties on matters of child custody and support (if applicable), alimony, and the division of the marital property, debts, and retirement benefits. The documents also include a mandatory Model Parenting Plan if there are minor children also subject the divorce action.
